Openly Gay Judge Overturns Prop 8: Idaho Reacts

Idaho is the nation’s proving ground for extremist and reactionary legislation. From the anti-Mormon laws passed way back when we were still a lowly territory, which didn’t allow voting or election to public office by anyone affiliated with the Mormon Church, to amending the Idaho Constitution to read “A marriage between a man and a woman is the only domestic legal union that shall be valid or recognized in this state”, if it’s just plain nuts, we’re gonna make it a law!

Yes, if you love Jesus and despise those who don’t, if you believe state rights trump the evil federal government, and you become sexually aroused at the mere mention of a concealed Glock-17, Idaho is your heaven on earth.

Rex Rammel hoped to grab the Republican nomination for Governor on a platform of seceding Idaho from the union if forced to accept “Obamacare”, not letting atheists vote or hold public office, and leading The Gem State using wisdom gained by talking directly to Elohim (Mormon overlord of planet earth). One would think this nut-job would be laughed at and dismissed for being insane, instead he received over 40,000 votes compared to incumbent Butch Otter’s 85,000. Nearly 50% of the Idaho Republican votes … Elohim help us all.

When Prop 8 was introduced in California to override the law allowing legal same-sex marriage, Mormon Church leaders called on prominent Mormon citizens from Idaho to dig deep and contribute to “save the sacred bond of marriage.” Millions of dollars were spent in the Golden State on a grassroots smear campaign to promote Prop 8 using biblical rhetoric and misinformation about the gay and lesbian community.

News Channel 8 is currently running a poll on their website asking “A California judge has overturned the state's ban on same-sex marriage. Do you agree with the decision?” The overwhelming majority replied “No, marriage should only be between a man and a woman. ” Not really a shocker, is it? We Idahoans don’t like liberals, the federal government, or anti-gun sissies. We sure as hell ain’t gonna have the homosexuals getting married.

I knew Prop 8 would pass; it was so heavily funded it couldn’t lose. But I also knew it would be overturned, because it’s knee-jerk legislation that targets a specific group of people and strips them of their civil rights. There is something called separation of church and state in this country, and regardless whether the moral majority is repulsed by the thought of two men having sex with one another, conservative Christians don’t get to define marriage in the United States of America using their Bibles or Book of Mormon as the reference manual for who can marry and who can’t.

The first Federal Judge to look at Prop 8 for constitutionality came back with the finding, “are you shitting me?” Granted, Judge Walker is openly gay, but just because he likes show tunes, fine wine, and subscribes to Playgirl doesn’t mean he isn’t an unbiased professional with an established track record for making fair decisions.

Of course Prop 8 is unconstitutional, and when it finally reaches the Supreme Court, they will come to the same conclusion. That pesky judicial branch of our government at it again, making sure we all have the same rights regardless of color, creed, religion, or sexual orientation. Protecting the minority voice, even when the overwhelming majority has copious funding, burning hatred, and Jesus on their side, because the founding fathers knew shit like this was going to pop up. Aren't checks and balances a bitch?

The Mormons and the Catholics and the Baptists finally have a common enemy. Using their untaxed tithing dollars, they will be throwing money at every piece of anti-gay (disguised as “save traditional marriage”) legislation from Maine to Oregon in hopes of stirring fears about the end of the American way of life.

Fuck the sick, fuck the hungry, fuck the poor … Christian religions are far more concerned with keeping those Godless homosexuals from getting married, and by the power vested in their tax-free contributions, they are going to see to it that gays and lesbians, regardless of the cost, are denied the same civil rights they themselves hold so near and dear when they preach about freedom from religious persecution.

The fight for same-sex marriage is only in the first rounds of what will prove to be an ugly drawn out brawl, but in the end, the decision handed down by the highest court in the land will reflect a common sense decision mostly free from religious bias, regardless of political pressure applied by the conservative Christian majority, because it’s the right thing to do.

And Bob and Bill will finally be able to get married, to each other, and share in the American dream.
