Montana Attorney General Mike McGrath sued Stimson Lumber Co. on Wednesday to force the removal of a berm, a wastewater pond and some old wooden structures at the defunct mill site near the mouth of the Blackfoot River.
The berm, pond, wood pilings and old foundations are dangerous and in immediate danger of collapse, the suit says. If the berm fails, Blackfoot River waters could wash toxic metals downstream.
Stimson has been working closely with the Montana Department of Environmental Quality for years, but the lawsuit says the company has not responded to repeated requests to address this cleanup—which could cost millions. The lawsuit seeks the removal of the old mill’s structures and the berm and cooling pond, which extend into the river, as well as money damages.

Stimson was to submit their proposed clean up plan to DEQ back in November. I would guess they didnt propose removing the cooling pond berm. Hence the lawsuit. Have you seen the Stimson proposal??? and is it available for public comment
