If the judge is truly focused on "the loan," as he claims, then its obvious that Edna Blixseth should also be on trial for 1/2 of that loan, since they were married at the time of "the loan" and she used that money to live a lavish lifestyle. So is the judge biased against Tim Blixseth?

I agree they both should have some culpability....she has done a pretty good job of staying below the surface with regards to this issue.

A lounge lizard is on trial because that is how he lives his life, manages his business, treats his partners, and the real estate market should not have had much to do with how well the Yellowstone Club operated. After all, you had to show you had x amount of money, liquid, before you could buy a lot, and then you had to build within a time frame. The buyers had CC&Rs;on them, but the money taker did not. The people buying into the YC had to prove some level of wealth, which on the surface should have meant that there would not be any great contraction in a down market. Only the receiver of the monies was not prudent, and by not being prudent, compromised all who are or were members of the YC...They paid their dues, built their homes, but TB et al did not prudently use the money he got for equity in the YC business, and due to divorce and market contraction, he got his ass in a jam....He did not do his due diligence, did not have or keep reserves for down times, for growth in service costs, for times of slow sales, what have you. When you depend on land sales to keep the services in place, there is something wrong with the business plan. If that information was not available to club members, but only to TB, then they have an expectation that there is a level of service owed them. The YC members should expect a certain level of financial protection in their investment as to services, utilities, general upkeep, payments to vendors and help. Their support of the club and concept made it what it is, and their support was floored by the expectation of tangible returns on their expenses to the daily upkeep and running of the Club..TB took his "blue sky" or "big blue sky" in the form of an equity loan from Credit Suisse, and kept the money. Subsequently, he had changes in his love life that precipitated a divorce. He now had more bills owing than he wanted to pay or could pay, and he is in court to see if he can skate and leave his creditors hanging. If you have followed his life, he is just where he wants to be. He has the money, and nobody is going to get it from him for any reason. No vendors paid, no partners paid, nobody paid but TB. And, this is the US, and there is nothing about being in court that is certain. Nothing. Except the lawyers are making money by the truck load, and TB has been there before and always landed on his feet. You can buy new friends. He will.

The rich YC Members, (the plaintiff Committee), are just mad that their property values are down, and they are looking for someone to blame, to try to recoup their losses. Why don't they accept their losses, like the rest of the country is doing in this down real estate market?
